The Bailiff said he will be at my home with a locksmith within 7 days to gain entry to my home can he do that?
Question by Pocket Tiger:
I paid a £65.00 car fine to the Court but did not pay as they had structured it as I was on Job Seekers Allowance and got paid fortnightly instead of weekly, and the Court wanted their money weekly. I also got behind as I had no money to pay trying to juggle paying bills and feeding myself. I even had to get a crisis loan from the Benefits Agency as I had no money for food. I received £27.00 which they deducted £5.92 from my money each week (paid fortnightly).

The court issued me with a £50.00 admin charge. Then I get a letter from the Bailiffs charging me £175 attendance fee. They called at 11.20 in the morning. I now have a new job and I was at work. The leaflet they posted through my letter box was not even in an envelope and was for anyone to see.
I am furious. The Bailiffs say they do not have to put it in an envelope unless it is a communial door. My mother picked up my post the other day and saw the leaflet. She is 79 and now beside herself with worry over me.

I am surprised you can afford to run a car.
You should have paid the fine when it was only £65
No they can’t force entry, but they do charge for every call to your property, so best to pay sooner rather than later.
Ever thought about going out and providing for yourself rather than getting all your bills and debts paid for by taxpayers.
If you fail to comply with a magistrates court order, they can issue a warrant for Bailiffs to seize your goods. If you were unable to comply, you should have gone back to the Court for a variation in the order.
Go to the Magistrates Court and register a complaint of “abuse of process” against the Bailiffs firm. The Court Office will tell you what to do next.
Baliffs have no right of entry to a private dwelling (your home bed sit or whatever) forcing entry is illegal unless it has been given the go ahead by the courts and a police officer is in attendance. I theory then they could do it but not likely for a few hundred quid. I would say however that settling with these guys as soon as possible is a good idea, the citizens advice bureau should be able to help you reach an acceptable aggreement with the baliffs. Call them tommorow and get an appointment asap.
Unless the bailiffs have been in and obtained a ‘walking posession order’ they cannot break in.
Ring them and sort it out, they wont leave you alone until you do. Go to CAB and get them to ring them on your behalf and make an offer to pay.
You need to go to the citizens advice to get this mess sorted.
Unless things have changed the court doesn’t send round the heavies/ bailiffs. There is more to this than you are telling.
so what. If you don’t want stuff like that happening, don’t break the law and pay you fines.
Bailiffs are trained Bully Boys. They will harass you on the day even if you have settled the Bill in the meanwhile . They will hike up the costs any which way they can. They are recruited for their lack of compassion primarily. So keep some evidence of having paid some and go to the Court and ask for the Clerk there to advise you .
I just forked out £250 and never had option of a bailiff
Not unless he has a walk in order.
The Bailiffs Rights of Entry:
The Bailiff cannot force entry into a domestic property.
The Bailiff can walk through an open door, climb over a garden wall, enter through an unlocked door or climb through an open window.
The Bailiff can force entry and seize goods if a debtor defaults on a Walking Possession Agreement. A Walking Possession Agreement can only be made after peaceful entry.
Walking Possession Agreement:
This is an agreement signed by the debtor which allows the goods to remain with the debtor as long as they keep to a payment arrangement. However if the debtor defaults on a payment arrangement the bailiff can return, force entry, and seize the goods.
